Website Legal Compliance Alert ? Why It's Risky To Copy Stuff Off ...

It?s tempting and so easy to use your right-click to download stuff off the Web ? to copy or save images, text, even videos. And this content is often great material for your website copy, squeeze page, sales page or banner ad.

Fair warning ? in most cases this content will be protected by copyright even if there is no copyright notice, and you will need a license or a valid claim of fair use to use it, or face a possible copyright infringement claim that could result in liability of up to $150,000 in damages.

The Rule of Automatic Copyright

The key to understanding why most content on the Web is copyright protected, even if it doesn?t have a copyright notice, is sometimes referred to as ?The Rule of Automatic Copyright.?

How copyrights are created is really simple, and that?s why it?s so often misunderstood. The Copyright Act says a work is created when it is ?fixed in a tangible medium of expression.? This means that a copyrightable work of authorship is created when pen hits paper, or keystrokes are recorded into the RAM of a computer, or video is recorded.

So, the fundamental rule is that copyrights are created automatically when an original work of authorship is fixed; no registration, copyright notice, or other act is required. And the copyrights vest in the author of the work. The copyright owner then controls to what extent another person can exercise the exclusive rights of a copyright owner ? the rights to copy, modify (create derivative works), distribute, display, and perform the work.

And very important, if you exercise of any of these exclusive rights without permission (a license) or a valid claim of fair use, you?re a copyright infringer subjecting you to claims for damages, in addition to other remedies.

What is Fair Use?

Fair use is a basic principle of copyright law that says the general public may use certain portions of a copyrighted work without a license from the copyright owner, provided the use is for purposes such as commentary, criticism, search engines, news reporting, research, teaching, library archiving or scholarship.

The catch is that if the copyright owner disagrees with the validity of your fair use claim, you may have a copyright infringement lawsuit on your hands.

To determine whether you have valid claim of fair use, four factors must be considered:

? The purpose and character of the use, including whether the use is a commercial use or for non-profit educational purposes, including the ?transformative? nature of the use;
? The nature of copyrighted work;
? The amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
? The effect of the use upon the potential market for or value of the copyrighted work.

The process of weighing and applying the four factors is, in fact intensive, and there is no bright line test. For example, with the first factor, a key question that weighs in favor of fair use is whether you have transformed the portion of the original work by adding new expression or meaning, such as with a parody, or by adding independently created images to quotes taken from a copyrighted article or speech.

Probably the most significant of the four factors in the context of use in connection with promotional material for your website copy, squeeze page, sales page or banner ad is the fourth factor ? the effect on the potential market for the copyrighted work.

One final tip: don?t fall into the trap of believing that if you acknowledge the copyright owner of the source material, your use is a fair use. On the one hand, acknowledgement may be a point to consider in weighing the four factors, but in and of itself it won?t protect against an infringement claim. And, what?s even worse, it may even create additional legal claims involving infringement of privacy rights.

Conclusion

Bottom line, it?s very risky to freely use your right click to download stuff off the Web. Copyrights to images, text and videos are almost always vested in someone. And the fair use defense to copyright infringement is very limited in scope, and generally poorly adapted for use with your website copy, squeeze page, sales page or banner ad.

It?s always best to get a license. That?s the only way to be sure you?ll not be facing a copyright infringement claim and a possible claim of up to $150,000 per work.

There is one thing that people who work in public relations know with certainty. Our moms don?t have a clue what we do. Neither do our dads, spouses or children. That makes it hard to claim you?ve had a stressful day because they think the toughest part of your day is choosing brown liquor or clear from the office booze cart, a la Mad Men. But now there?s proof. Public relations has been rated the world?s fifth most stressful profession by the job search company CareerCast, ahead of police officers, taxi drivers, newspaper reporters and senior corporate executives. Here?s how you explain it to mom.

People get most stressed when they have responsibility for (and are judged on) an outcome, but they have little authority to affect that outcome. It?s like judging the weatherman on the weather, rather than the accuracy of the weather forecast.

So, as a PR professional you may be responsible for getting a glowing story in the (National Post, Wall Street Journal, Times of London, whatever) that describes your client?s leader as having the heart of Gandhi, brains of Einstein, vision of Steve Jobs and business acumen of Warren Buffet. He/she must convince a cynical, skeptical reporter to write a fluffy, promotional piece highlighting only the very best information about the client. Of course, no credible reporter will do that, so we start from the position that under the best possible circumstances, if everything goes right, the goal is unattainable.

Still, the PR person dutifully tries to find a positive yet newsworthy angle to meet the journalist?s requirement that the story have some element of conflict and transformation. (There are no bad stories, only bad PR people.)

Often this is where the client gives the PR person helpful direction.

?You?ve got to focus on the fact that we are a strategic, cutting edge company, a global leader with leading strategic solutions and that our revolutionary prizo-digi-voltaic innovative diphthong solution positions us for strategic growth and strategic performance. I know everybody else already has prizo-digi-voltaic diphthong solutions but we need the market to know that we do too. And whatever you do, don?t let them mention in the story that the CEO has been charged with embezzlement and theft of intellectual property ? When you apply this reality to the PR agency environment, where each PR person serves three to 10 clients, you multiply the stress by the number of clients. A Smut Above: Unhealthy Soot in the Air Could Also Promote Global Warming

Black carbon, commonly described as soot, may play a larger role in global warming than previously estimated, according to a new study. Every year in the Northern Hemisphere about 7.5 million metric tons of black carbon, the equivalent of more than 100 times Earth?s total biomass, enters the air from internal combustion engines, forest fires and other sources. The fine material absorbs sunlight almost as well as carbon dioxide?a well-known greenhouse gas?and may contribute to accelerated snowmelts and increased global temperatures. "We?re trying to figure out how to deal with the greenhouse gas problem " says Sarah Doherty, an atmospheric scientist at the University of Washington in Seattle and co-author of the study. The new findings suggest that black carbon mitigation should be part of that strategy. Scientists have known about the warming potential of black carbon for years, but Doherty's study, published yesterday in the Journal of Geophysical Research: Atmospheres, suggests previous calculations underestimated its impact. Doherty and her colleagues used a compilation of dozens of climate models to look at the life span of atmospheric black carbon. By imputing observational data recorded around the world, they studied the effect this pollutant might have on the Northern Hemisphere. By itself, black carbon is a warming agent; however, it is not usually emitted in a pure form. Instead, black carbon is expelled into the atmosphere combined with other compounds such as sulfates, which affect their heat-absorbing and reflective properties. Black carbon could be seen as chocolate chips in baking, Doherty says by way of analogy. "In one case you put them in molasses cookies, and the other case you put them in sugar cookies." The result: cookies with different tastes and textures. For example, black carbon from diesel engines is known to cause atmospheric warming because it is mixed with sulfates, says study co-author Tami Bond, an atmospheric scientist at the University of Illinois at Urbana?Champaign. Forest fires in the lower latitudes, however, are actually beneficial sources of black carbon because it is coupled with organic aerosols and ends up reflecting light and heat, causing the surrounding area to cool. Atmospheric black carbon?s impact on climatic warming also varies due to its altitude. The team discovered that the consequences of black carbon and whether it promotes or combats climate change depend on its position?above, below or in the middle of cloud cover: Above the clouds, where the particulates absorb heat more readily, they produce a warming effect; below the cloud deck heat absorption is less significant. Such disparities cause problems for scientists trying to describe the atmospheric effects accurately. According to the study, black carbon compounds have the potential to decrease the world's average temperature by 0.5 degree Celsius or warm it by 1.08 degrees C, depending on how it was produced. Previous studies lacked the observational data included in Doherty?s analysis, making earlier estimates much less accurate. Thus, policymakers have to consider the source of black carbon when drafting mitigation ordinances, Doherty says. Although researchers still debate the overall influence of black carbon on the atmosphere, scientists do agree that it has become a serious health issue for populations on the ground. Inhaling black carbon could aggravate serious chronic illnesses such as asthma. Because black carbon only remains in the atmosphere for about a week, decreasing emissions translates into immediate health benefits. The rapid change could also prove a victory for world leaders trying to rally support for climate policy. "Once you stop the emissions, it?s gone. It?s a public health win," Bond says. Stocks rise after better housing, jobless reports

NEW YORK (AP) ? Stocks advanced, pushing the Standard and Poor's 500 to another five-year high, after strong reports on housing starts and unemployment claims made investors more optimistic about the U.S. economy.

The S&P 500 gained five points to 1,478 as of 11:05 a.m. EST Thursday, and earlier climbed as high as 1,480, its highest level since December 2007. The Dow Jones industrial average also rose, gaining 57 points to 13,568. The Nasdaq composite rose 11 points to 3,129.

U.S. builders started work on homes in December at the fastest pace since the summer of 2008, the Commerce Department said Thursday. Homebuilder stocks rose broadly following the report. Lennar rose 83 cents to $41.35, KB Home gained 28 cents to $16.43 and D.R. Horton rose 42 cents to $21.42.

The number of Americans seeking unemployment benefits fell to a five-year low last week, the Labor Department reported, the latest sign that the job market is healing. Weekly unemployment benefit applications fell 37,000 to 335,000, a bigger decline than economists had forecast, according to financial data provider FactSet.

The reports helped offset disappointment over the fourth-quarter earnings report of two of the nation's biggest banks, Citigroup and Bank of America, said JJ Kinahan, chief derivatives strategist at TD Ameritrade.

"The financial stocks are having a tough time impressing the Street with anything," Kinahan said. "The traditional banks are getting squeezed on margins and the expectations for a lot of those companies had already been set low."

Citigroup fell $1.20 to $41.28 after its income fell well short of Wall Street's expectations. The bank's legal expenses rose and it released less money from its loan-loss reserves.

Bank of America also dropped 39 cents to $11.39 after its earnings declined. The bank is continuing to work on clearing up old problems at its mortgage unit. The bank made $367 million in the last three months of 2012 after paying preferred dividends, down sharply from $1.6 billion in the same period a year ago.

Boeing fell 87 cents to $73.47 after the Federal Aviation Administration said late Wednesday that it was temporarily grounding Boeing's 787 Dreamliners after battery problems led to an emergency landing of an All Nippon Airways flight. The plane makers stock dropped 3.4 percent the day before.

Stocks started 2013 with a rally after lawmakers came up with a last-minute plan to stop the U.S. going over the "fiscal cliff," a series of tax hikes and spending cuts that economists say would probably have pushed the U.S. into recession.

The yield on the 10-year Treasury note, which moves inversely to its price, rose three basis points to 1.87 percent.

Other stocks making big moves:

? EBay rose $1.43 to $54.33 after reporting fourth-quarter earnings that exceeded analysts' expectations. Bargain-hunting holiday shoppers flocked to eBay's online shopping mall and digital payment service.

? CBS surged $3.96 to $41.89 after the media company said late Wednesday that it was converting its U.S. outdoor advertising business to a real estate investment trust and selling the international portion of the business.

? BlackRock gained $7.07 to $229.30 after the investment manager said its fourth-quarter net income surged, beating analysts' forecasts. The company also increased its dividend.

Debt Ceiling Fears Simply Theater For Gold Bears

Markets trade off of a strange mix of rumor, hard facts, and innuendo. But the one thing we can count on today is that whatever narrative is being spun by governments and central bankers is what will push the markets in the direction they want them to go. I've been an observer of this long enough now to look past what is being said, and try to make sense of what is actually happening. It seems as if every 60 days there is another crisis of market-shattering proportions. If this crisis is not resolved the way those with power want, then the consequences will be unspeakably horrible.

In effect, it's all theater to keep us reacting and not reasoning. Fear is the mind-killer, after all.

Markets dominated by massive hedge fund high-frequency volatility -- whose computer algorithms are trading off of headlines and key phrases in central bank pronouncements, as opposed to market fundamentals -- sow confusion and create fear when they should be discovering prices. In gold and silver, this fear is created through massive stop-loss raids.

This brings me to my first question. Do you honestly think Congress will not raise the debt ceiling when the time comes?

Given the statements by President Obama and outgoing Treasury Secretary Tim Geithner recently, it is pretty clear that if the House Republicans attempt to shut down the government, the hedge funds will crash the markets in retaliation. Read Geithner's letter (see link) and tell me that Goldman Sachs et al. would hesitate to play out the same drama it did during the original TARP vote four-and-a-half years ago when the Dow dropped 770 points in a day. They wheeled in a Big Board for that one. The only thing missing was George C. Scott and a few nuclear bombs.

Politically, the debt ceiling fight is a non-starter for Boehner and the Republicans, lest anyone forget Newt Gingrich (believe me, I try to every day). Therefore, it is a foregone conclusion -- in my mind -- that the debt ceiling will be raised. So this is nothing to fear.

Repatriation A-Go-Go

Once the debt ceiling is raised, the last bit of uncertainty regarding where U.S. monetary and fiscal policies are headed will be removed. This will allow the markets to fully price in the effects of QE 2 and QE 4. Like the theater last summer over Spain and Italy, which brought the euro to its breaking point, these past five months have been staged to promulgate the fear of default and/or contraction in the U.S. That would be highly credit-deflationary and bad for gold in the short run. The endgame in Europe was the consolidation of power by Germany over the PIIGS, with the ECB as their leg-breaker. But neither catastrophe was ever a credible threat. It was a brilliant power play by the Germans to advance the euro project and a convenient time-buying mechanism for the Fed.

First, we were supposed to fear Romney's threat to Bernanke's job if he won the election. Then, on election night when he lost, it was the fiscal cliff we needed to worry about. Before the ink was dry on that deal we were moved right to being scared of the debt ceiling.

There wasn't even an intermission between acts to take a deep breath. It doesn't matter. It worked. The important strategic commodities (gold, silver, oil, and copper) stayed range-bound, even if they kept making higher lows on each correction.

But at what price? The amount of intervention into the gold (GLD) and silver (SLV) markets to keep prices under control was staggering. More than 200 of tons of gold were moved to China alone through Hong Kong. And that's just what they reported publicly. There have been rumblings coming out of Germany for months now, and on Monday evening a report I found on Zerohedge indicated that the Bundesbank will repatriate some of its gold. This isn't Hugo Chavez, folks. This is Germany and Germany has been playing for keeps during this entire eurozone crisis.

The immediate speculation from the gold bulls' side is: What happens when the Fed or the French cannot produce the Germans' gold because it has been loaned out almost a hundred times? That would be bad, certainly, but I don't think that's even necessary to speculate on. The Bundesbank will get its gold. The bigger question is: What happens when the next country asks?

And here's my second question: Has the current price management scheme in gold and silver gone on so long that the central banks are breaking ranks and moving to protect themselves from each other? China has already made its intentions clear by refusing to buy U.S. Treasuries and recycling its current account surplus into gold and other commodities.

The Swiss have let go of their peg against the euro (FXE). This will allow it to buy back all of those Francs it printed and get a little extra gold in the process. Buy low, sell high. Since the ECB's announcement last week not to raise rates, the EURCHF has risen sharply. I wouldn't doubt if January's TIC Report shows the Swiss selling some U.S. Treasuries.

The $1,800 Glass Ceiling

Any novice chart reader can look at $1,800 per ounce and see how important that price is to the gold market -- a quadruple top on the monthly chart. But the seeds for another assault on $1,800 have already been sown. All that remains is for the last small threat of deflation to be erased, and then there will be no credible means by which to talk the gold price down from where it wants to go.

Between now and that day, however, we can expect a barrage of bearishness and speculation that will create the idea of a gold bull market that is over. When, in reality, this is simply a long pause before the next leg up in the cycle. The House Republicans may even make a grand finale to their little stage play and shut down the government for a few days, playing to their portion of the crowd, while the punditocracy shouts epithets from each end of the gallery -- cue Rachel Maddow and Sean Hannity.

In that case, I would expect to see gold get flushed to re-test the December low of $1626 and possibly lower. Only on a weekly close first below $1,600 and then $1,520 would I be worried about the validity of the gold bull market.

However, if we see a break of December's high at $1,718 this month -- not a high probability right now, just 46.3% as of the close Jan. 14 -- then that would likely set up a very strong February, just in time for the final act in this drama. Or is that tragedy? Either way, it doesn't matter.

Gold's role in this drama hasn't even begun yet. Gold is like Orson Welles in "The Third Man," off-screen and only seen in glimpses until the final act -- a specter weighing on everyone's conscience and presumed dead. But unlike Harry Lime, who was a fake and an immoral slimeball to boot, when gold shows up onscreen it will be all the other currencies that wind up shot dead in a sewer.

Which brings me to my last question: Are you prepared for what happens then?

Appalachian State University?released two documents Monday evening related to the ouster of legendary football coach Jerry Moore, including a letter from Dec. 20, 2011 in which athletic director Charlie Cobb asked Moore to step down.

Both documents are included at the end of this blog.

In a memo to chancellor Kenneth Peacock dated 11 days later, Cobb said Moore had rejected a three-year contract offer (at $100,000 annually) to step down as coach and become Special Assistant to the Athletic Director, and Cobb recommended ?the school agree to Moore?s request to coach one final season.

The school announced earlier this month that Moore (215-87 in 24 seasons with the Mountaineers) was no longer the coach, a move in which Moore has said ?blindsided? him.

The documents were released in response to a Citizen-Times request through the Freedom of Information Act.

Portions of the letter and memo are redacted.

Cobb declined an interview request from the Citizen-Times on Tuesday.

Moore couldn?t be reached for comment, and Peacock didn?t respond to interview requests.

In the letter to Moore, dated Dec. 20, 2011, Cobb listed several reasons for wanting to make a change ? ?a lack of chemistry on the coaching staff, the potential for 6-7 new coaches due to attrition, a new strength coach for the off-season?and the lingering mood surrounding the program.?

Cobb also wrote that there was pressure from unnamed people to make a change.

?Short of being able?to guarantee a championship season, I?m not sure people, especially the ones that matter ? will be satisfied,? Cobb wrote.?

Moore finished with?winning seasons in each of last 19 seasons with ASU, including an 8-4 mark this season when the Mountaineers won the Southern Conference title for the seventh time in eight years and?reached the FCS playoffs for an eighth straight season.

The Mountaineers were 87-24 in Moore?s last eight seasons, with three straight FCS national?championships (2005-07), a 53-8 record in SoCon play and a 15-6 mark in the playoffs.

When Moore was asked to step down last year, he was coming off an 8-4 record, the first time?since 2004 that the program hadn?t won at least 10 games.???

Cobb wrote of his admiration for Moore and his concern that if he remained as coach, his health could be threatened and the legacy and all he built at ASU could be tarnished.?

After offering Moore the new job, the letter ends with Cobb asking Moore to speak with his wife Margaret and think about the offer for a couple?of days.

In the Dec. 31?memo from Cobb to Peacock, Cobb wrote ?we (Cobb and Peacock) agree it is time for Coach Moore to retire.?

Cobb wrote that Moore?s response to the job offer was to request one final season of coaching in 2012. ???

?Cobb recommended that Moore coach the 2012 season and that he retire immediately?after the final game.

?This would be communicated immediately to him and the staff and announced?publicly in the spring, although?it is assumed that it will be public before then,? Cobb wrote.

Cobb also wrote that he expected Moore to retire even if the program won a national championship.

He also referred to the ?disjointed chemistry (during the 2011 season) that eventually (a)ffected every person involved in the program.?

Seven ASU assistants left the program after the 2011 season, including Moore?s son Chris, who had been on his father?s staff for 13 years.

Four of those seven went from ASU to Western Carolina, including Mark Speir, the Catamounts? head coach.

Moore has said in previous interviews that he didn?t?agree?to any deal where 2012 would be his final season.

There was not a public announcement from ASU that 2012?would be Moore?s final season, and the news earlier this month that Moore was ousted against his wishes ?surprised and angered many?Mountaineers? fans. ??

appreciate everything that Margaret and you have done for Lindsay, my kids, and me since

I was named AD in May 2005. Harrison still talks about coach giving him his first

Appalachian t-shirt at Hilton Head.

Through the years and especially recently since ?sitting in this chair? I?ve learned that men

sometimes have a difficult time expressing their true feelings when they sit and talk. Last

night, as I lay awake trying to figure out the right things, I remembered that you gave me a

book the day before our 2005 game against Coastal Carolina. So, I opened it again to read

the passage that you wrote thanking me for the energy being created for the first game.

Your words were as true last night as they were that first weekend.

Over the past couple of weeks, I?ve thought a lot about the football program, but, most

importantly, you and Margaret. What we?ve accomplished the past seven years is

remarkable when anyone thinks back to the circumstances of 2005. Coach, I am genuinely

concerned for you and for Margaret. I see our strengths ? the tradition, our reputation,

facilities, and scholarship funding ? and realize most of this has been accomplished in the

recent cycle. However, I also see our weaknesses ? the lack of chemistry on your staff, the

potential for 6-7 new coaches due to attrition, a new strength coach for the off-season

workouts, and the lingering mood surrounding the program from as you describe ? a tough

season.? I also don?t see a program that is in disarray because we have good kids and good

players, but one that needs new voices. I have no doubts that you will work longer and

harder to make it work, but you are only one man of 12-13 others responsible for the

direction. What I see for the next year is a man that I revere paddling as hard as he can so

as to not drown versus being able to stand and admire all that he has built.

Right now, we have a chance to build the appropriate legacy for you with this program.

Without a doubt, you have raised the expectation bar, but I firmly believe that where we

are right now goes way beyond wins and losses. At most places, an 8-win season is

celebrated, but you acknowledged to many throughout the season that this was your

toughest year in coaching. Short of being able to guarantee a championship season, I?m not

sure people, especially the ones that matter ? will be satisfied. And, honestly, even if we

were to win a fourth title, does that make it all good in the end if you have to exhaust

yourself physically and mentally to accomplish it? I think back to Margaret?s reaction after

the Maine game and am worried that the risk to everything you?ve accomplished is not

worth trying to win a few more ball games. As I told you on Sunday, I do not want you to

become (REDACTED) or Appalachian to become (REDACTED) by you and me trying to make this

partnership work too long.

Everybody that loves and respects you is trying to protect you and your legacy. No one

wants to see you (REDACTED). We

care too much. Regardless of your willpower and mental toughness, the reality of next

season is a year without (REDACTED), new coaches whose commitment to you

and the program is unknown, a new strength coach leading the off-season program, and the

?is this Coach?s last year? prevalent before and during the season. And, unlike 2005 when I

arrived, there is no clear cohesion among your staff about direction and I?m not sure that

the proper trust can be created by a group of new coaches in a short period of time. I also

think trying to put that staff together is going to be tough given our circumstances? My

guess is about right now, you?re getting charged up and ready to fight the fight. That?s not

my intention in writing this. My intention is to clearly point out to you the great challenges

that lie in front of us in trying to make another season work. Being rational, I do not think

the 20-hour days or sleeping in your office is in your best interest.

I write all this to tell you ?it?s time.? I also know that everybody who knows your family

and our current situation feels the same way. Why?

1. This protects you and your legacy at Appalachian. As (REDACTED) told you,

this is the very best possible exit strategy because you go out ?a winner.?

2. The timing allows for the proper transition of the program. I am fairly

confident that the new coach will keep some of the remaining staff, so these

guys can be taken care of as well. We can execute a search quickly after

Christmas, so any lost momentum in the recruiting cycle will be minimal.

3. Emotionally, it allows you and Margaret the ability to go do many new and

exciting things without the strain of another season. I?ve witnessed this

transition with (REDACTED)

4. And finally, financially, this is the best deal for you and Margaret.

i. The job title is ?Special Assistant to the Athletics Director.? In essence,

you would be a friendraiser and fundraiser for football program?

Our ambassador. You can be around the program and kids daily. You

will have an office near Rick and me to use as necessary.

ii. Technically, we would set the job up to be an independent contractor

relationship paid by Yosef Club. This allows you to earn income from

speeches, presentations, etc. without undue restraint by the

University. You would have to establish your own health coverage,

but we can work with the guys at Blue Cross to put something

together.

iii. This would be a three-year commitment (January 1, 2012 ? December

31, 2014) at $100,000 per year. You also would be eligible to start

drawing your retirement, which is an additional (REDACTED) per month.

Additionally, your monthly social security is added too. Plus, by

retiring, you can immediately receive payment for your accrued

vacation time, which is currently (REDACTED) before taxes. So, financially,

you are making as much or more as you currently do.

Coach, I understand what I?m asking. I ask you to share this with Margaret and think about

this over the next couple of days. With everything going on, if I didn?t think this was in your

best interest, I would not come to you with this. I trust you and Margaret understand that.

Ken, as part of our discussions, I felt this could help facilitate the conversation.

We agree that it is time for Coach Moore to retire. I communicated this to him prior to Christmas. After some thought, he understands that it is time for him to define his retirement but has requested to coach one final season in 2012. And while I was initially disappointed that Coach was not in agreement with everything I proposed, I have since thought through all the positives and negatives of his request and strongly believe this is the best option for all parties involved. I have tried to think about what is best for Appalachian while also thinking about how you or I would respond to a similar request. I am comfortable that the following recommendation addresses our two major concerns after the season ? a definitive retirement date for Coach and several staff changes ? that were accomplished in the past two weeks.

Recommendation:

The 2012 football season is Coach Moore?s last season as head coach. He will retire immediately following the final game of the 2012 season. This would be communicated immediately to him and the staff and announced publicly in the spring although it is assumed that it will be public before then.

This solution is best for Appalachian based on the following 3 reasons:

1.

Potential FBS transition

?As we discussed before the holidays, the conference realignment process has reached the point that it touches Appalachian. We should know this spring or summer what opportunities, if any, exist for us. This will make our future conference affiliation a known part of the decision-making process following the 2012 season and not speculative, as it would be in the next several weeks. I cannot stress the importance of knowing this direction in terms of creating the best available candidate pool. Also, potentially, the 2012 season will be the first of our 2-year transition period. If so, it is beneficial for this to begin with our existing situation instead of a new staff in terms of creating momentum during the transition years.

Financial.

Coach Moore has a salary agreement offered and approved by the BOT in 2009 to coach the 2012-2013 season at a base salary of $230,000. (REDACTED).? Additionally, I calculated that we owe an additional $265,000 in severance and accrued vacation leave to the 11 members of our current staff. This puts the total financial commitment at $500,000 to make a change at this point in time.

The right new head coach will want somewhere in the $250,000-350,000 annual range and my guess is $650,000 for his assistant?s salaries. (REDACTED) The head coach?s annual salary is $500,000 and the pool for assistants is $1.3 million. For comparison, our salary pool for 10 assistants is currently $520,000, which is third in the SoCon Given (REDACTED) our continuing need to absorb the out-of-state waiver and the recent reduction in our approved student fee request for 2012-13 by approximately $225,000, I am not comfortable spending from our current operating budget or reserves, especially as this could negatively impact funds for possible realignment. I do think that we will need to increase spending for the vacant assistant coaching positions, but this will be a fraction of costs for a new staff.

Our 2012 schedule is one of the best in recent memory. We will meet our ticket sales goal. We just completed a fundraising year where we reached $1 million by December 31 for the first time in history. We are currently more than 10% ahead of last year, which set a record for the Yosef Club.

Public Relations.

Of the roughly 250 Division I football programs, Appalachian trails only Boise State in terms of number of games won during the past seven years. I have no doubt that it is in Appalachian?s best interest to allow a natural transition with Jerry versus terminating him, which is what this would be. Secondly, we all anticipate another difficult budget year for campus. Based on current issues, I do not see a viable way for you or me to explain to interested parties how we spent the referenced money. I also think we can be successful in 2012 if everyone is committed to making this work because we have already answered the chemistry questions of 2011 with current staff changes.

There are plenty of respectable coaches who will coach the 2012 season at Appalachian under this scenario once the go-ahead is given. I also do not think a transition year will negatively impact recruiting for several reasons. One, effective recruiting is an inexact science by nature. Second, over the last several years, kids being recruited by us have not come in with the expectation to play for Coach their entire college careers. Three, because of the unstable nature of coaching, no kid being recruited by any staff in America can be honestly told that they will play for that coach or staff for his entire career. In the SoCon alone, every team but Wofford and us changed head coaches in the past five years or, more accurately, during the college life of kids in the 2011 graduating class.

This is something that I will establish with Coach?if you are on board?with this recommendation. I believe I can do this in a way that helps Coach and the football program if we have an agreement on my role from the beginning. Ken, the 8-3 season (the team actually finished 8-4) of 2011 was enver about a lack of talent but solely about?disjointed chemistry that eventually (a)ffected every person involved in the program. With these issues resolved, we have a team that can compete.

There is nothing more that would be a storybook ending to this journey for Appalachian, Coach Moore and thousands of Appalachian fans for our football team to win a 4th?National Championship in Coach?s final year. I believe?that with you and the Board of Trustees? support we have a legitimate chance of making this happen.?

Wilko Johnson is choosing to go out on a high note.?The former Dr. Feelgood guitarist and songwriter, who won a new legion of fans as mute executioner Ser Ilyn Payne on ?Game of Thrones,? has been diagnosed with terminal pancreatic cancer and is choosing to forgo chemotherapy, according to a message posted to Johnson?s Facebook page by his manager, Robert Hoy.

But, according to Hoy, the 65-year-old Johnson is determined to live life to the fullest for as long as he can.

?Game of Thrones? was one of the most pirated shows in 2012

?He is currently in good spirits, is not yet suffering any physical effects and can expect to enjoy at least another few months of reasonable health and activity,? Hoy?s post continued, detailing Johnson?s plans to finish a new CD, tour France, give a series of farewell concerts in the U.K. and release a live DVD from his last U.K. tour.

Zambia bans hunting of big cats

Zambia has banned the hunting of lions and leopards because of the rapid decline in its numbers of big cats.

Zambia's tourism minister said there was more value in game-viewing tourism than blood sport, which brought in just $3m (?1.9m) last year.

Sylvia Masebo said the country did not have enough cats for hunting purposes.

"Tourists come to Zambia to see the lion and if we lose the lion we will be killing our tourism industry," she told Reuters.

But Chuma Simukonda from the Zambia Wildlife Authority (ZAWA) said the ban would be bad for tourism.

"The population of cats in Zambia is around 3,400 to 3,500 and with the ban on safari hunting for cats, we are likely to lose on revenue," he told the AFP news agency.

He said about 55 cats were killed by hunters each year.

Neighbouring Botswana is banning all sport hunting from 2014, while Kenya halted hunting for sport decades ago.

Lottery winner killed by cyanide was immigrant, family man - US News

Urooj Khan, 46, won $1 million off a scratch lottery ticket he bought at a 7-11 in Chicago last June, but just one day after receiving his check, he died. Now, his death has been ruled a homicide, as toxicology reports showed deadly cyanide in his system. NBC's Andrea Canning reports.

The wheel of fortune spun fast for Urooj Khan.

The Indian immigrant and Chicago-area dry cleaning store owner struck it big with a $1 million lottery win in June. He died a month later, succumbing to cyanide poisoning in what police are now investigating as a homicide.

The death was a dark end to the family man?s otherwise hopeful tale.

Khan came to Chicago in the 1980s and found work in a local dry cleaning business. After years of working for others, he opened Style Dry Cleaners in the Rogers Park area of Chicago in 2004. Over time, Khan became proprietor of three dry cleaning stores of his own, according to the Chicago Tribune.

He also owned five condominiums, which he rented out, the paper reported.

In a June 26 press release from the Illinois Lottery, a giddy Khan described his reaction after buying his golden ticket at a 7-Eleven in Rogers Park. ?I scratched the ticket, then I kept on saying, ?I hit a million!? over and over again,? an effusive Khan said of his sudden riches. ?I jumped two feet in the air, then ran back into the store and tipped the clerk $100.?

Khan stood to bank $424,449.60? from the win after taxes on his lump sum payout of over $600,000. He would give some of the money to St. Jude Children?s Research hospital, he said, and invest another share in his dry cleaning business. The lucky entrepreneur gripped an oversized check at the summer lottery ceremony where he was joined by his wife, Shabana Ansari, 32, and their daughter Jasmeen, along with several friends.

?Winning the lottery means everything to me,? Khan gushed in June.

But he never got to enjoy the windfall, dying suddenly on July 20, just one day after the check with his winnings was issued by the Illinois Comptroller?s Office.

Cook County Medical Examiner Stephen Cina performed a limited exam on the 46-year-old and found no signs of trauma. Cina?s office concluded that he had died of natural causes. Six months later, in a sudden turn of events, officials said on Monday that they were looking into Khan?s case again after further toxicology reports determined that his system held lethal amounts of cyanide.

Those tests were run at the urging of an unnamed family member.

Khan?s wife described him as a ?kind and good-hearted person? to NBCChicago.com. Khan ate dinner at home with his family on the night he died, the Tribune reported, citing an internal police document. He went to bed. After he awoke screaming in the night, he was taken to St. Francis Hospital, where he was pronounced dead.

Khan was a ?workaholic,? his wife of 12 years told the paper. ?He made clients happy by doing his job. He could not be everywhere, but he had to be everywhere.?

Khan?s purchase of the winning ticket came in a moment of weakness, convenience store clerk Ashur Oshana told The Associated Press. The doomed man had sworn off gambling in 2010 after going on the hajj, the pilgrimage all faithful Muslims are obligated to make once in their lives. He yielded to temptation one last time, and laid down $60 for a pair of scratch-offs.

?Right away he grabbed my hand,? Oshana said of Khan?s emotional win. ?He kissed my hand and kissed my head and gave me $100. He was really happy.?

Jimmy Goreel owns the convenience store where Khan bought his winning ticket. He said Khan had been kind to him after an earlier, smaller win.

?I sold him a winning ticket for $5,000,? Goreel told NBCChicago.com. ?He was so generous he reached for a hundred dollars, and he threw it on the counter for me.?

?He was a family man who worked hard for his family,? Goreel said. ?I just can?t see it happening. If that?s true, it?s sad.?

Khan was buried at Chicago?s Rosehill Cemetery. Cina said exhuming his body may be the next step in investigating the death.

Nikon outs Coolpix S6500 with WiFi, new beauty touchups

The budget, compact long-zoom camera field must be a cutthroat one -- Nikon unveiled the Coolpix S6300 early last year, quietly slipped out the S6400 later in 2012, and it's already previewing a S6500 at CES. What's new that justifies such a quick refresh? WiFi, mostly: the S6500 should be one of the less expensive cameras in its class to share its photos directly over a local network. Photographers with self-conscious subjects also get five new Glamor Retouch modes that brighten cheeks, eyes and teeth. Otherwise, those who bought an S6400 will feel like they're in familiar territory between the 16-megapixel backlit CMOS sensor, 12x (25-300mm equivalent) lens and 1080p video capture. The S6500 arrives towards the end of January for $220, which makes it low-hanging fruit for anyone who wants a dash of everything in their next point-and-shoot upgrade.
